Nobody needs to travel to Spain
The entire transfer can be completed under power of attorney. We prepare the power of attorney for each person involved, explain exactly what is being signed, and arrange signature wherever that person lives. We then sign the deed before the notary in Spain on your behalf. No appointment in Spain, and no appearance at a notary's office, is required of you.
Two ways a property changes hands
The first is inheritance, after an owner has died. The second is a gift made during the owner's lifetime, typically to pass the property to children or grandchildren at a time of the owner's choosing rather than leaving it to be dealt with later. Both are handled the same way, by us, from beginning to end.
Keeping the right to use the property (usufruct)
When a property is passed on during your lifetime, you do not have to give up the use of it. You can transfer the ownership to the next generation now and keep the right to use the property for the rest of your life — to go on living in it yourself, or to keep the rent if it is let. In Spanish this retained right is called the usufructo. The alternative is a full transfer, where the new owner receives both the ownership and the use. Either is possible, and we set out what each one means for you before you choose.
You see the whole cost before you decide
Before anything begins, you receive a written breakdown of every cost the process involves — the taxes, the notary, the registry fees and our own fee. You decide with that figure in front of you, and nothing is set in motion until you tell us to go ahead.
Notary, Land Registry and Catastro
We arrange the notary and the signing of the deed, register the new ownership at the Land Registry (Registro de la Propiedad), and update the record at the Catastro, so the property is recorded in the new owner's name in both places.
The tax payments
We calculate the taxes arising, prepare and file them, and make the payments on your behalf, so that side of it is closed and documented.
What it costs
Every case is different — the fee depends on how many people are involved, how many properties, and the region. That is why the cost breakdown comes first: you see the full figure, ours included, before the process begins.
What you receive at the end
The new title deed, registered in the new owner's name at the Land Registry; the updated Catastro record; and the receipts for every tax and fee paid along the way. Everything arrives as PDF files by email, and the originals are sent to you.
